Article 2- Subject-Subject:

The subject of this Agreement includes the electronic sale of the products and services purchased by the Buyer and the determination of the mutual rights and obligations of the Parties regarding the delivery of these products in accordance with the provisions of the Agreement. With the relevant provisions of the Consumer Protection Law No. 6502 and the Regulation on the Implementation Procedures and Principles of Distance Contracts.

 

Article 3- Information regarding the Products subject to the contract, Payment Conditions, Withdrawal and Delivery Conditions:

3.2- Payment Terms:

Payment is made by the buyer via credit card/debit card through the payment system at www.myartproof.com before the code is received. The Buyer acknowledges that he/she cannot access the relevant code without making the necessary payment.

Your bank may organize campaigns and apply more installments than the installment you have chosen and may provide you with services such as deferring these installment payments. Such campaigns are entirely at the discretion of your bank, and if our company is aware of them, information about the campaigns can be provided on our websites. Any transaction carried out between the Consumer/Buyer and the bank as a result of the sales transaction is outside the responsibility of the SELLER. Any disputes that may arise in this regard are not binding on the seller.

3.3 - Return Procedure and Right of Withdrawal:

The Consumer has the right to withdraw from this Distance Selling Agreement signed with the Seller within 14 (fourteen) days without giving any reason and without paying any penalty. The exercise period of the right of withdrawal begins on the date of signing of the contracts regarding the performance of the service and the date on which the goods are received by the Consumer or a third party to be determined by the Consumer. , regarding contracts for the delivery of goods. However, the Consumer may exercise his right of withdrawal within the period from the conclusion of the contract to the delivery of the goods. In determining the period of use of the right of withdrawal;

For goods that are subject to a single order and delivered separately, the last day on which the Consumer or a third party designated by the Consumer receives the goods is taken into account;

For goods consisting of more than one piece, the day on which the Consumer or a third party designated by the Consumer receives the last piece of the goods is taken as basis;

In contracts where goods are delivered regularly for a certain period of time, the day on which the Consumer or the third party designated by the Consumer receives the first goods is taken as basis.

You can make your withdrawal notification by making a written request to info@bestebankasi.net from your registered e-mail address before your right of withdrawal expires. The payment amount you have made within the scope of your right of withdrawal will be refunded to you within 7 business days at the latest. However, it should be noted here that the Buyer cannot exercise the right of withdrawal in the following contracts:

- Contracts regarding goods prepared in line with the wishes or personal needs of the consumer.

-Contracts regarding books, digital content and computer consumables presented in tangible media if the protective elements such as packaging, tape, seal and package have been opened after the delivery of the goods.

-Contracts regarding the delivery of periodicals such as newspapers and magazines other than those provided within the scope of subscription agreements.

- Contracts regarding services performed instantly in electronic environment or intangible goods delivered instantly to the consumer.

- Contracts regarding services whose performance started with the approval of the Consumer before the exercise of the right of withdrawal ends.

If the Consumer chooses the payment option with "Shopping Credit", the Consumer declares, accepts and undertakes that the right of withdrawal from the Instant/Distance Shopping Credit Agreement will be applied within the scope of the Instant/Distance Shopping Credit. The contract concluded between the Bank and the Consumer. The Consumer's withdrawal from this Distance Sales Agreement with the Seller will not automatically terminate the Instant/Distance Shopping Credit Agreement with the Bank. In order for the Consumer to withdraw from the Instant/Distance Shopping Credit Agreement, the Consumer must send a withdrawal request to the Bank that provided the loan in accordance with the procedures specified in the Instant/Distance Shopping Credit Agreement, within the periods specified in the Instant/Distance Shopping Credit Agreement. In this context, if the Consumer's notification to the Bank is not made at all or is made delayed, the Seller cannot be held responsible or responsible for the credit relationship between the Seller and the Seller. Bank and Consumer.

Article 4- General Provisions:

4.1- The Consumer/Buyer acknowledges that he/she has read and is informed about the basic characteristics of the product subject to the contract, the sales price of the product including taxes, payment terms and delivery conditions, and that he/she has read the preliminary information regarding the Seller's full commercial name, full address and contact information and is aware of these issues. has given the necessary confirmation regarding the matter electronically. By confirming this contract electronically, the Buyer confirms that he/she has obtained the information that should be given to the Consumer by the Seller regarding the address, basic features of the ordered products, and the product to be delivered, before the conclusion of the distance sales contracts. The price of the products including taxes,

4.2- The code will be given to the user as soon as possible after successful payment of the product. The user will be able to use the service provided with this code.

4.3- After the sale of the services and products subject to this contract is completed, the Seller will not have any responsibility regarding these products.

4.4- If the relevant bank or financial institution does not pay the price of the product to the Seller due to unfair or illegal use of the Consumer/Buyer's credit card after the delivery of the product, by unauthorized persons due to the faults of the Consumer/Buyer; The product must be returned to the Seller, provided that it has been delivered to the Consumer/Buyer in person.

4.5- In order for the product to be returned, the relevant sections of the invoice we have sent to you in accordance with the Tax Procedure Law General Communiqué No. 385 must be filled in completely and sent back to us together with the product. the product after you signed the invoice

Article 5- Disputes and Competent Jurisdiction:

Regarding any dispute arising from or in relation to this Agreement; Provincial or District Consumer Arbitration Committees in the place where the consumer transaction is made or where the Consumer resides are authorized for disputes up to the values ​​announced annually by the Ministry of Customs and Trade. In disputes over the above-mentioned values, the Consumer Courts in the place where the Consumer transaction is made or where the Consumer resides are the competent courts. In places where Consumer Courts do not exist, Civil Courts of First Instance are authorized.

From the moment the order is placed, the Consumer/Buyer is deemed to have accepted all the terms of this Agreement.
